Le Président du Conseil des Droits de l’Homme nomme trois experts pour enquêter sur le crime israélien contre la Flotille de Liberté

Une bonne nouvelle nous parviens du Palais des Nations à Genève, où le Président du Conseil des Droits de l’Homme, Son Excellence l’Ambassadeur Sihasak Phuangketkew, vient de nommer les membres de la mission d’enquête décidé par le Conseil pour enquêter sur le crime international de mer contre la Flotille de la Liberté. Les trois experts doivent rendre rapport de leurs investigations au Conseil à sa prochaine 15e session ordinaire, en septembre 2010.

Les travaux de la Mission sont à suivre de prêt, notamment après la restauration du statut consultatif auprès du Conseil économique et social des Nations Unies de la Commission arabe des droits humains, l’une des principales ONG actives dans la défense des droits humains des citoyens arabes et surtout du peuple palestinien auprès des instances et des organes internationaux de protection des droits humains, notamment le Conseil des Droits de l'Homme (CDH) des Nations Unies à Genève et la Cour Pénale Internationale (CPI) à La Haye.

Le temps de l'Impunité est révolu. Les criminels sionistes d'Israël et d'ailleurs, qu'ils soient aux commandes politiques ou militaires, qu'ils soient décideurs, planificateurs ou exécutants, doivent rendre compte de leurs crimes

Cette mission d'enquête redonne confiance aux victimes et renouvelle la foi en la justice internationale. Elle sera d'une grande utilité à nous autres Défenseurs des droits humains pour convaincre Monsieur le Procureur près la Cour Pénale Internationale d'engager, sans délai, des poursuites contre les instigateurs, les planificateurs et les exécutants des crimes sionistes israéliens perpétrés depuis plus de 60 ans, depuis la Nakba, contre notre peuple palestinien frère.

Nous autres tunisiennes et tunisiens avons une responsabilité supplémentaire, du fait des liens fraternels qui nous ont unis avec les combattants palestiniens de la Liberté, notamment lors du long séjour de feu le Zaïm Yasser Arafat à deux pas du domicile des Hani à Hamam-Chatt, la présence des organes de l'OLP sur notre terre et le lourd tribu payé par la Tunisie et son peuple lors du crime d'agression israélien contre le Quartier-Général de l'OLP à Hammam-Chatt le 1er octobre 1985.

S'ajoute à cela la position combien Lucide, Courageuse, Responsable et Juste de notre Diplomatie, depuis le discours historique du feu le Zaïm Habib Bourguiba à Jérico (Ariha) en 1965 et depuis les succès obtenus notamment en 1985 et en 1989 au Conseil de Sécurité des Nations Unies, en faveur de la cause palestinienne.

La Tunisie, son Gouvernement, sa Diplomatie, son Peuple, sa très riche et plurielle Société civile, ses Intellectuels, ses Journalistes... doit œuvrer inlassablement jusqu'au recouvrement du peuple palestinien frère de l'ensemble de ses droits, Humains et Nationaux, pour éviter la dichotomie, longtemps imposée par une certaine pensée faussement 'révolutionnaire' panarabe, entre Droits Humains des Individus et Droits Nationaux des Peuples.

Nous reviendrons, depuis Genève Inchallah, aux résultats de ladite mission, à la prochaine session ordinaire du Conseil. Si les portes du pays s'ouvrent à notre modeste personne de Âîd / Retornado en attente de son passeport depuis plus d'un an, nous commenterons le rapport de la mission depuis Hammam-Chat Inchallah.

Le Conseil des droits de l'homme des Nations Unies nomme trois experts pour enquêter sur le raid israélien sur la Flotille pour Gaza

Genève (23 juillet 2010) – Le Président du Conseil des droits de l’homme des Nations Unies, S.E. Sihasak Phuangketkeow, a nommé trois experts de premier plan pour prendre part à la mission internationale indépendante d'établissement des faits chargée d'« enquêter sur les violations du droit international, y compris le droit international humanitaire et le droit international des droits de l’homme résultant de l’attaque israélienne contre la flotille de bateaux transportant de l’aide humanitaire », qui est intervenue le 31 mai dernier. Il s'agit du Juge Karl T. Hudson-Phillips, de Sir Desmond de Silva et de Mary Shanthi Dairiam*.

Les noms des trois experts ont été annoncés vendredi par l'ambassadeur Sihasak Phuangketkeow. « L'expertise, l’indépendance et l’impartialité des membres de la mission seront dévolus à clarifier les événements survenus ce jour-là et leur légalité. Nous appelons toutes les parties à coopérer pleinement avec la mission et nous espérons que cette dernière contribuera à la paix dans la région et à la justice pour les victimes », a-t-il déclaré.

La mise sur pied d’une mission internationale indépendante d’établissement des faits destinée à examiner « les graves attaques menées par les forces israéliennes contre le convoi humanitaire de bateaux » a été décidée par le Conseil des droits de l’homme (résolution 14/1) le 2 juin 2010. Le Conseil avait précédemment tenu un débat urgent sur le raid des Forces de défense israéliennes contre la flotille pour Gaza. A cette occasion, cet organe des Nations Unies a déploré « la mort de civils innocents ».

Les experts vont maintenant définir leur plan d’action et prendre contact avec toutes les parties concernées avant de partir pour la région. Ils doivent présenter le résultat de leurs investigations au Conseil des droits de l’homme lors de sa 15e session, au mois de septembre 2010.
(*) Juge Karl T. Hudson-Phillips (Trinité-et-Tobago), C.R., a été juge à la Cour pénale internationale de 2003 à 2007. Il a été Procureur général et Ministre des Affaires juridiques de la Trinité-et-Tobago de 1969 à 1973. Il a été nommé Conseil de la Reine (C.R.) en 1971. Il a désormais repris une clientèle privée auprès de Chambers à la Trinité-et-Tobago et à la Grenade, dans les Antilles.

Sir Desmond de Silva (Royaume-Uni), C.R., est un juriste au bénéfice d'une vaste expérience dans le domaine des droits de l’homme, des crimes de guerre, du terrorisme, de la criminalité économique, des procès d’espionnage et du droit du sport. Il a été Procureur en chef du Tribunal Spécial pour la Sierra Leone en 2005, avec rang de sous-secrétaire général des Nations Unies. Il est Conseil de la Reine (C.R.) depuis 1984.

Mary Shanthi Dairiam (Malaisie) a été membre du Comité pour l’élimination de la discrimination à l’égard des femmes de 2005 à 2008. Depuis 2007, elle oeuvre au sein du groupe de travail sur l’égalité des sexes du Programme des Nations Unies pour le Développement. Elle est membre fondateur du Conseil d’administration de l’International Women’s Rights Action Watch Asia Pacific.

United Nations Human Rights Council panel to investigate Israeli raid on Gaza Flotilla established

GENEVA (23 July 2010) – The President of the United Nations Human Rights Council, Ambassador Sihasak Phuangketkeow, has appointed three preeminent experts to an independent international fact-finding mission to “investigate violations of international law, including international humanitarian and human rights law, resulting from the Israeli attacks on the flotilla of ships carrying humanitarian assistance” which took place on 31 May. The experts are: Judge Karl T. Hudson-Phillips, Sir Desmond de Silva, and Mary Shanthi Dairiam*.

In announcing their appointment, Ambassador Sihasak Phuangketkeow said: "The expertise, independence and impartiality of the members of the mission will be devoted to clarifying the events which took place that day and their legality. We call upon all parties to fully cooperate with the mission and hope that this mission will contribute to peace in the region and justice for the victims”.

The establishment of this independent international fact-finding mission was decided on 2 June 2010 by the Council with its resolution 14/1. The Council had previously held an urgent debate on the raid on the Flotilla by Israeli Defense Forces. This United Nations body deplored "the loss of life of innocent civilians" during that debate.

The experts will now define their plan of action and make contact with all relevant parties prior to travelling to the region. They are expected to report on their findings to the United Nations Human Rights Council at its fifteenth session in September 2010.


(*) Judge Karl T. Hudson-Phillips, QC (Trinidad and Tobago), served as a Judge of the International Criminal Court from 2003 to 2007. He was Attorney General and Minister of Legal Affairs of Trinidad and Tobago between 1969 and 1973. He was appointed Queen’s Counsel (QC) in 1971. He has now returned to private practice with Chambers in Trinidad and Tobago and Grenada, West Indies.

Sir Desmond de Silva, QC (United Kingdom), is a lawyer with extensive experience in human rights, war crimes, terrorism, business crime, espionage trials and sports law. He served as Chief Prosecutor of the UN backed Special Court for Sierra Leone in 2005 at the level of an Under-Secretary General of the United Nations. He has been Queen’s Counsel (QC) since 1984.

Mary Shanthi Dairiam (Malaysia) was a member of the Committee on the Elimination of Discrimination against Women from 2005 to 2008. Since 2007, she has been serving on the Gender Equality Task Force of the United Nations Development Programme. She is a founding member of the Board of Directors of the International Women’s Rights Action Watch Asia Pacific.
