Le Comité FreeMourad lance un appel à la Présidente du Conseil des Droits de l'Homme


23 février 2012 - Le Comité de soutien FreeMourad a appelé Mme Laura Dupuy Lasserre, Présidente du Conseil des droits de l'homme de l'Organisation des Nations Unies, à saisir les autorités françaises de la situation du Dr Mourad Dhina et à attirer leur attention sur la gravité de leur décision d'arrêter un militant des droits de l’homme et un opposant politique pacifique au régime en place en Algérie.

Le Comité rappelle que cette arrestation va totalement à contresens des développements historiques qui se produisent dans la région du Maghreb et du Machrek, et qu’une extradition du Dr Dhina constituerait une violation grave des obligations internationales de la France en matière de respect des droits de l'homme.

Le 15 Février 2012, la demande de libération conditionnelle du Dr Dhina avait été rejetée par la justice française alors même que les conditions légales pour une telle remise en liberté étaient réunies; au cours de la même audience, la cour de Paris avait renvoyé l’examen de la demande d'extradition au 21 Mars 2012.

Le régime algérien accuse le Dr Dhina d’une prétendue « appartenance à un groupe terroriste armé » qui aurait agi à Zurich et en Suisse entre 1997 et 1999, sans toutefois préciser ni les faits visés ni la date à laquelle ceux-ci auraient été commis.

Le Comité s'étonne de ce que les autorités françaises aient cru devoir donner suite à cette demande d’arrestation alors même que la Convention d’extradition en vigueur entre la France et l’Algérie impose que toute demande doit être accompagnée « d’un exposé circonstancié des faits pour lesquels l’extradition est demandée, indiquant le plus exactement possible le temps et le lieu où ils ont été commis ».

Le Comité FreeMourad considère que l'arrestation du Dr Dhina à la demande du régime algérien est de nature purement politique, et qu’elle est exclusivement motivée par ses activités de défenseur des droits humains dans le monde arabe et par son engagement pour un changement démocratique dans son pays.

Le Comité craint qu’en cas d’extradition vers l’Algérie, le Dr Dhina n’y soit exposé à la torture et/ou autres mauvais traitements, et réaffirme qu’une telle décision constituerait une violation grave des obligations de la France en matière de respect de la Convention des Nations Unies contre la torture et de la Convention européenne des droits de l'homme

FreeMourad Committee calls on President of Human Rights Council to act


23 February 2012 - The Free Mourad Committee has called on Ms Laura Dupuy Lasserre, President of the United Nations Human Rights Council, to bring the case of Mourad Dhina to the attention of the French authorities and to highlight the gravity of their decision to arrest a human rights defender and peaceful political opponent of the Algerian regime.


The Committee pointed out that this arrest runs against the historic developments occurring in the Arab region and extraditing Dr Dhina would constitute a grave violation of France’s international human rights obligations.


Furthermore, on 15 February, Dr Dhina‘s request for conditional release was rejected, despite all the legal requirements for such a release being fulfilled. His next hearing, during which the judge will consider the extradition request, was set for 21 March 2012.


The Algerian regime accuses Dr Dhina of “belonging to an armed terrorist group active in Zurich and Switzerland between 1997 and 1999”, without any further precisions as to which actual offences he is alleged to have committed and at which dates.


The Committee finds it astonishing that the French authorities found it appropriate to act on the decade old Algerian request when the extradition convention between France and Algeria states that any such extradition request must be accompanied by “a statement of the offences for which extradition is requested, indicating as precisely as possible the time and the place where these were committed.”


The Free Mourad Committee considers that Dr Dhina’s arrest in view of extradition to Algeria is of a purely political nature, and is the result of the work he has undertaken as a human rights defender and for his calls for democratic change in his country of origin.


The Committee further fears that he would be at risk of torture and ill-treatment if he should be sent back to Algeria, given the regularly documented human rights violations committed by the Algerian authorities. This extradition would be contrary to France’s obligations under both the United Nations Convention against Torture and the European Convention on Human Rights.
