الإعلان عن منح الجائزة يصادف الذكرى السنوية الأولى لاعتقاله

12 تشرين الأول/أكتوبر 2010 - جنيف، سويسرا – ستمنح جائزة الكرامة 2010 للمدافعين عن حقوق الإنسان إلى السيد هيثم المالح، المحامي، واحد أبرز المدافعين السورين عن حقوق الإنسان، وسيتم حفل تسليم جائزة الكرامة الخاصة بالمدافعين عن حقوق الإنسان في 10 كانون الأول/ ديسمبر 2010 بمركز المؤتمرات الدولية (www.cicg.ch) في جنيف، سويسرا.

وبهذا الشأن، أعلن السيد رشيد مسلي، المدير القانوني لمنظمة الكرامة، عبر شريط فيديو تم بثه اليوم على الانترنت على موقع الكرامة، أن الحائز على جائزة عام 2010 هو السيد المالح، معربا عن بالغ أسفه لعدم تمكن السيد المالح المشاركة بهذه المناسبة، نظرا لوجوده حاليا رهن الاعتقال في سجن عدرا في دمشق. وقال السيد مسلي "ونحن نقترب من الذكرى السنوية الأولى لسجن هيثم المالح، تعرب الكرامة عن تضامنها مع السيد المالح وتنضم إلى باقي أفراد عائلته والعديد من المنظمات غير الحكومية الأخرى للمطالبة بإطلاق سراحه فورا، كما نأمل من أعماق قلوبنا أن يتمكن السيد المالح من المجيء إلى جنيف يوم 10 كانون الأول/ ديسمبر ليتسلم هذه الجائزة لتكريمه على ما بذله من عمل جليل في مجال حقوق الإنسان".

وللتذكير فقد اتهم السيد المالح "بتقويض الشعور القومي" و "نشر أخبار كاذبة" وحُكِم عليه بالسجن لمدة ثلاث سنوات في حزيران/ يونيو 2010. ومنذ اعتقاله قبل نحو عام، لم يسمح له بالحصول على الرعاية الطبية اللازمة مما أسفر عن تدهور تدريجي في وضعه الصحي، الأمر الذي قد يؤدي في نهاية المطاف إلى تفاقم خطير في حالته الصحية في حالة استمرار احتجازه.

عملية القبض على السيد هيثم المالح


اختطف السيد هيثم المالح في 14 تشرين الأول/ أكتوبر 2009، خارج مكتبه، على يدي عناصر من جهاز أمن الدولة، في أعقاب مقابلة أجراها عن طريق الهاتف مع القناة التلفزيونية للمعارضة السورية بردى ومقرها لندن، حيث انتقد من خلالها بشكل علني، السلطات السورية لقمعها المستمر لحرية التعبير واستخدامها لقوانين حالة الطوارئ لتبرير العديد من انتهاكات حقوق الإنسان. وقد اختفى السيد المالح لمدة خمسة أيام، قبل أن يظهر من جديد في 19 تشرين الأول/ أكتوبر 2009، لتوجه له تهمة "نشر معلومات كاذبة من شأنها أن تقوض الروح المعنوية للأمة"، وحُكِم عليه بعد ذلك من قبل محكمة عسكرية، على الرغم من كونه لا يحمل أية صفة أو رتبة عسكرية. وفي أعقاب هذه المحاكمة الجائرة، التي لم يسمح له فيها بتلقي المساعدة القانونية الواجبة، صدر بحقه في 4 تموز/ يوليو 2010 حكم بعقوبة السجن مدتها ثلاث سنوات، فيما تعتبر الكرامة أن مجريات هذه المحاكمة والحكم الصادر فيها على السيد المالح من قبل المحكمة العسكرية في دمشق، يشكلان انتهاكا للعهد الدولي الخاص بالحقوق المدنية والسياسية، الذي صادقت عليه سوريا في 21 نيسان/ أبريل 1969.

وتجدر الإشارة، أنه منذ القبض على السيد المالح، راسلت الكرامة كل من المقرر الخاص المعني بالصحة، وفريق العمل المعني بحالات الاختفاء القسري، وفريق العمل المعني بحالات الاحتجاز التعسفي، والمقرر الخاص المعني بالتعذيب، ولجنة مناهضة التعذيب، والأمين العام للأمم المتحدة، لإحاطتهم علما بملبسات القضية، كما وجهت الكرامة، بالاشتراك مع 21 منظمة غير حكومية سورية أخرى، رسالة إلى الرئيس السوري، تطالبه فيها بالإفراج الفوري عن السيد المالح، غير أن السلطات السورية، لم تستجب حتى الآن بشكل علني، لأي من النداءات المطالبة بالإفراج عنه.

تزايد انتهاكات حقوق الإنسان في سورية

ومعروف عن الحكومة السورية سجلها الثقيلفي مجال قمع حرية التعبير وأنشطة المجتمع المدني، الأمر الذي يحد بشكل كبير من نطاق عمل المدافعين عن حقوق الإنسان، وأيضا من عمل الصحفيين والمدونين. وقد كانت الحالات الأخيرة التي تناولتها الكرامة بخصوص سورية، تتمحور بشكل رئيسي حول قضايا الاختفاء القسري والاعتقال التعسفي التي تعرض لها مواطنون، ذنبهم الوحيد ممارستهم حقهم المشروع في حرية التعبير، بشكل سلمي.

جائزة الكرامة للمدافعين عن حقوق الإنسان

تمنح جائزة الكرامة سنويا للمدافعين عن حقوق الإنسان، بمناسبة اليوم العالمي لحقوق الإنسان. وتهدف هذه الجائزة إلى تكريم الشخص أو المؤسسة التي ساهمت إلى حد كبير في حماية وتعزيز حقوق الإنسان في العالم العربي.
وقد منحت جائزة الكرامة للمدافعين عن حقوق الإنسان في السنة الماضية، إلى الأستاذ المحامي، السيد علي يحيى عبد النور.

نبذة عن حياة هيثم المالح

ولد السيد هيثم المالح في دمشق في عام 1931، واشتغل محاميا منذ أوائل خمسينات القرن الماضي وأصبح قاضيا في عام 1957 وذلك إلى غاية 1966، وفي عام 2001 أنشأ جمعية حقوق الإنسان في سوريا.

وقد أمضى السيد المالح العقود الأربعة الماضية في الدفاع عن حقوق السوريين من كافة المستويات الاجتماعية، ومن جميع الانتماءات الأيديولوجية والسياسية، وفي كل منطقة من مناطق البلاد، وقد حصل على جوائز دولية عديدة لقاء عمله في مجال حقوق الإنسان، وتحدث في مناسبات عديدة في الجامعات، والمؤتمرات، وحتى أمام البرلمانات في جميع أنحاء العالم.

وقد تعرض السيد المالح، بسبب طبيعة عمله في مجال الدفاع عن حقوق الإنسان في سورية، للسجن دون محاكمة بل ودون أن توجه إليه أي تهمة، وذلك في الفترة ما بين عامي 1980 و 1987؛ ومثل أمام المحكمة العسكرية على نشره مجلة في عام 2002؛ وسحبت منه رخصة مزاولة عمل المحاماة في عام 2003؛ ومنع مرارا من السفر خارج الوطن ومن إلقاء المحاضرات منذ كانون الثاني/يناير 2004.

وقد تحدث السيد المالح عن الحاجة الملحة إلى ضرورة تنفيذ الدستور السوري بشكل كامل وشامل، وعن واجب حماية حقوق جميع السوريين، وفق الضمانات المنصوص عليها في الدستور.

عن الكرامة



تأسست الكرامة كمنظمة غير حكومية في عام 2004 وفق القانون السويسري، بمبادرة من فريق من المحامين ونشطاء حقوق الإنسان المتطوعين قصد المساهمة في تعزيز وحماية حقوق الإنسان، في العالم العربي.

وتعمل الكرامة بشكل وثيق مع مصادر محلية في المنطقة العربية لجمع المعلومات بشكل مباشر عن انتهاكات حقوق الإنسان.



وللكرامة مكاتب وممثلين في جنيف (سويسرا)، ولندن (بريطانيا)، وبيروت (لبنان) والدوحة (قطر) وصنعاء (اليمن) إلى جانب العديد من المراسلين والمتطوعين في جميع البلدان العربية.

Syrian Haithem Al-Maleh to receive 2010 Alkarama Award for Human Rights Defenders


Announcement marks first anniversary of his detention

12 October, 2010 – Geneva, Switzerland – Haithem Al-Maleh (هيثم المالح), prominent Syrian human rights defender and lawyer, will be the recipient of the Alkarama Award 2010 for Human Rights Defenders. The award will be presented on 10 December 2010 at the annual Alkarama Award for Human Rights Defenders, which will take place at the International Conference Centre (www.cicg.ch) in Geneva, Switzerland.

Rachid Mesli, legal director of Alkarama, made an online video broadcast today on Alkarama's website announcing Mr Al-Maleh as the 2010 laureate. Mr Al-Maleh was unfortunately unable to participate, as he is currently detained in Adra Prison in Damascus.

“As we approach the first anniversary of Haitham Al-Maleh’s imprisonment, Alkarama joins his family and numerous NGOs in calling for his immediate release. We sincerely hope he will be able to come to Geneva on 10 December to receive this award honouring his work,” said Mr Mesli.

Mr Al-Maleh has been charged with “weakening national sentiment” and “spreading false news” and was sentenced to three years imprisonment in June 2010. Since his arrest nearly a year ago he has not had access to adequate medical attention. Consequently his health is gradually deteriorating, which could eventually lead grave health difficulties should his detention continue.

Haithem Al-Maleh’s arrest


Haithem Al-Maleh was abducted on 14 October 2009 outside his office by State Security agents, only a few days after giving a telephone interview for the London-based Barada TV. In the interview he criticised Syria’s continued repression of freedom of expression and its use of the State of Emergency laws to justify numerous human rights violations. Mr Al-Maleh disappeared for five days, reappearing on 19 October 2009, only to be charged with “disseminating false information that would affect the morale of the nation”. He was then tried before a military court, even though he holds no military rank or status. Following this unfair trial, during which he was denied legal counsel, he was sentenced on 4 July 2010 to three years in prison. Alkarama regards the trial and sentencing of Mr Al-Maleh by Damascus’ Military Court as a violation of the International Covenant on Civil and Political Rights (ICCPR), which Syria ratified on 21 April 1969.

Since his arrest, Alkarama has brought Mr Al-Maleh’s case to the attention of the Special Rapporteur on Health, the Working Group on Disappearances, the Working Group on Arbitrary Detention, the Special Rapporteur on Torture, the Committee Against Torture, and the Secretary General of the United Nations. Alkarama and 21 other Syrian and international NGOs have also jointly written to the President of Syria, requesting the immediate release of Mr Al-Maleh. The Syrian authorities have, to date, failed to publicly respond to any of the appeals for his release.

Human rights violations increasing in Syria

The Syrian government has a long history of repression of freedom of expression and civil society actions which limits the work of human rights defenders but also journalists and bloggers. Alkarama’s most recent Syrian cases have mainly concerned the enforced disappearances and arbitrary detention of citizens who have peacefully exercised their right to the freedom of expression.

The Alkarama Award for Human Rights Defenders

The Alkarama Award for Human Rights Defenders is awarded annually on the World Human Rights Day. The Alkarama Award honours a person or organisation that has contributed significantly to the protection and promotion of human rights in the Arab world.

Last year’s Alkarama Award for Human Rights Defenders laureate was Addernour Ali Yahia of Algeria.

About Haithem Al-Maleh

Born in Damascus in 1931, Haithem Al-Maleh has been a lawyer since the early 1950s. He became a judge in 1957 until 1966 and in 2001 created the Human Rights Association in Syria (HRAS).
Mr Al-Maleh has spent the last four decades defending the rights of Syrians from every level of society, ideological and political persuasion, and in every region of the country. He has been presented with numerous international prizes for his human rights work and spoken many times at universities, conferences, and even before parliaments around the world.

Due to his human rights work in Syria, Mr Al-Maleh has previously been imprisoned without being tried or charged between 1980 and 1987; brought before a military tribunal for publishing a magazine in 2002; had his lawyer’s license revoked in 2003; and has been banned from travel and from giving lectures since January of 2004.

Mr Al-Maleh has spoken of the need for the Syrian Constitution to be fully and completely implemented, and for the rights of all Syrians, as guaranteed in this constitution, to be protected.

Haitham Al-Maleh, lauréat 2010 du prix Alkarama pour les défenseurs des droits de l'homme


Cette annonce marque le premier anniversaire de sa détention

12 octobre, 2010 – Genève, Suisse– Haitham Al-Maleh (هيثم المالح), éminent avocat et défenseur des droits de l'homme syrien recevra le prix Alkarama pour les défenseurs des droits de l'homme pour l'année 2010. La cérémonie de remise de prix aura lieu le 10 décembre 2010 au Centre international de conférences de Genève (www.cicg.ch), en Suisse.

Dans une vidéo postée aujoud'hui sur le site web d'Alkarama, Rachid Mesli, directeur juridique de l'organisation, a annoncé que le prix Alkarama Award serait décerné cette année à M. Al-Maleh. Actuellement détenu à la prison d'Adra à Damas, M. Al-Maleh n'a malheureusement pas été en mesure de participer.
M. Mesli a déclaré: “A l'approche du premier anniversaire de la détention de Haitham Al-Maleh, Alkarama souhaite se joindre à sa famille et aux nombreuses ONG qui le soutiennent pour demander sa libération immédiate. Nous espérons de tout coeur qu'il sera en mesure de se rendre à Genève pour recevoir cette distinction qui récompense le travail exemplaire qu'il a accompli en matière de défense et de promotion des droits de l'homme. »

En juin 2010, M. Al-Maleh a été condamné à trois années d'emprisonnement pour « affaiblissement du sentiment national » et « diffusion de fausses nouvelles ». Depuis son arrestation, il y a près d'un an, il n'a pu bénéficier d'aucune prise en charge médicale alors qu'il souffre de graves problèmes de santé. S'il reste détenu, son état de santé pourrait continuer de se détériorer.

L'arrestation de Haitham Al-Maleh

Haitham Al-Maleh a été enlevé le 14 octobre 2009 à la sortie de son lieu de travail par des agents de la Sûreté de l'Etat après avoir accordé une interview par téléphone à Barada TV, chaîne de télévision basée à Londres. Au cours de cet entretien, il a ouvertement critiqué les autorités syriennes pour la constante répression qu'elles exercent contre ceux qui aspirent à s'exprimer librement. Il a aussi dénoncé le fait que les lois sur l'état d'urgence sont régulièrement utilisées pour justifier des violations massives des droits de l'homme. M.
Al-Maleh a disparu pendant cinq jours. Ce n'est que le 19 octobre 2009 qu'il est réapparu, uniquement pour être accusé de « diffusion de fausses informations susceptibles de porter atteinte au moral de la nation ». Il a ensuite été traduit devant un tribunal militaire alors qu'il n'a aucun statut militaire. A la suite de ce procès inéquitable, durant lequel il n'a pu bénéficier d'aucune assistance juridique, il a été condamné le 4 juillet 2010 à trois ans de prison. Alkarama considère que le procès et la condamnation de M. Al-Maleh par le tribunal militaire de Damas constituent une violation du Pacte international relatif aux droits civils et politiques, ratifié par la Syrie le 21 avril 1969.

Depuis son arrestation, Alkarama a soumis le cas de M. Al-Maleh aux Rapporteurs spéciaux sur la santé et sur la torture, aux Groupes de travail sur les disparitions forcées et sur la détention arbitraire ainsi qu'au Comité contre la torture et au Secrétaire général des Nations unies. Alkarama et vingt-et-une ONG, tant syriennes qu'internationales, ont écrit conjointement une lettre au président syrien pour demander la libération immédiate de M. Al-Maleh. A ce jour, les autorités syriennes sont restées muettes face aux nombreux appels à sa libération.

Mainmise sur la liberté d'expression/ Violations des droits de l'homme en nette augmentation en Syrie
Depuis de nombreuses années, les autorités syriennes se sont attachées à mettre en place des mesures de répression visant autant les défenseurs des droits de l'homme que les journalistes et les blogueurs afin d'étouffer la liberté d'expression et d'avoir mainmise sur la société civile. Parmi les cas syriens récemment traités par Alkarama, nombreux sont ceux qui ont été victimes de disparition forcée et de détention arbitraire simplement pour avoir exercé leur droit à la liberté d'expression de manière pacifique.

Le prix Alkarama Award pour les défenseurs des droits de l'homme

Le prix Alkarama Award pour les défenseurs des droits de l'homme est décerné chaque année à l'occasion de la Journée mondiale des droits de l'homme. Il récompense une personnalité ou une organisation qui a contribué de manière significative à la protection et à la promotion des droits de l'homme dans le Monde arabe.

Le lauréat 2009 du prix Alkarama Award pour les défenseurs des droits de l'homme était le défenseur des droits de l'homme algérien Abdennour Ali Yahia.

A propos de Haitham Al-Maleh

Né à Damas en 1931, Haitham Al-Maleh a commencé sa carrière d'avocat au début des années 1950. Il a exercé la profession de juge de 1957 à 1966 et a créé, en 2001, l'Assocation syrienne pour la défense des droits de l'homme.

M. Al-Maleh s'est consacré au cours des quarante dernières années à la défense des droits des Syriens à travers tout le pays, sans aucune distinction, quelle qu'ait été leur appartenance sociale, idéologique ou politique. Il a reçu de nombreux prix internationaux pour son travail de défenseur des droits de l'homme, a participé à de nombreuses conférences et même pris la parole devant des assemblées parlementaires à travers le monde.

En raison de son activité de défenseur des droits de l'homme en Syrie, M. Al-Maleh a déjà été emprisonné entre 1980 et 1987 sans procès, ni accusation. Il a été traduit devant un tribunal militaire en 2002 pour publication d'un magazine, a été radié du barreau en 2003 et s'est vu à plusieurs reprises empêcher de voyager et de participer à des conférences depuis janvier 2004.
M. Al-Maleh a défendu la nécessité de l'application stricte de la constitution syrienne et a plaidé en faveur de la protection des droits de tous les Syriens, tels que garantis par cette législation.
